Public Environmental Rights: A New Paradigm for Environmental Law?
The SCC has written about the fundamental importance of environmental protection. However, this approach has not been supported in the courts. This paper argues that the reason for the absence of a shift in case law is that env. lawyers have not made the case for the legal nature of env. problems.
